Washington, D.C. — On June 15, Rep. Barry Moore voted in support of H.R. 288, the Separation of Powers Restoration Act, sponsored by Rep. Scott Fitzgerald (R-WI). This legislation would scale back Chevron deference, which is a precedent that allows the courts to defer the interpretation of the law to government agencies if Congress has not weighed in on a matter.
"The American people elect legislators to create our laws, and they can un-elect those legislators when they support bad policy," said Moore. "Chevron deference gives unconstitutional power to bureaucratic executive branch agencies by allowing them to make laws rather than just enforce laws. These bureaucrats were never elected, and therefore cannot be fired by the American people. For too long, Congress has allowed democracy to die in a cubicle through needless regulations, and it is past time to tear down the red tape and return power to representatives elected by the American people."
